- “Server” or “Company Server” means the computer software or hardware that serves and hosts the Website to users across the Internet.
- “Purchase” or “order” have the meaning set forth in Section 5 herein.

This Agreement shall not be interpreted to: (i) grant any rights to any User in or to any of the Company IP Assets except for the limited Access Right set forth and subject to the terms and conditions of Section 2.1 of this Agreement; or (ii) transfer any rights in any Company IP Assets or in any other Company intellectual property rights from Company to any Users.
4. PRIVACY
- All of the terms and conditions of the ROM AMERICA Privacy Policy (as defined above), which shall govern all Users of the Website.
- Registration of an ROM AMERICA Account. You may access most areas of the Website and purchase goods or services offered for sale by ROM AMERICA to you, including but not limited to through the Website (the “Products”), without registering an account with us, but certain areas and features of the Website will only be available to you if you register for an account (an “ROM AMERICA Account”). If you choose to register for an ROM AMERICA Account, you agree to complete the initial account registration process according to the requirements stated on the Website, and to provide accurate and complete information including, but not limited to, your legal name, and email address.
- Closing an ROM AMERICA Account. You may voluntarily close your ROM AMERICA Account at any time by canceling it on the Website or by sending us an email to email in which you request that we terminate your ROM AMERICA Account.
- ROM AMERICA’s Right to Close ROM AMERICA Accounts. We have the right to disable any ROM AMERICA Account at any time upon any of the following events: (1) Your breach of any of the terms or conditions of this Agreement or the ROM AMERICA Privacy Policy or any other ROM AMERICA policies that govern the procurement of Products; or (2) Upon the occurrence of any other instance as set forth in the ROM AMERICA Privacy Policy.
- As a result of the Company exercising any other right it has to terminate this Agreement.
- PURCHASES. When making a purchase of any Products (a “purchase” or “order”), including without limitation when you make any payments for an order using any third party payment solutions provided through the Website, you must provide accurate and complete information (including your full and proper name) as required when making that order and when otherwise using a credit card or other payment card (such as the payment cardholder name, payment card number, expiration date, and if requested, payment card security code) at the time of submitting your order form. You represent and warrant to ROM AMERICA that your use of a payment card in connection with any purchase you make on or through the Website (including without limitation any credit card payments you make for an order using any third party payment solutions) is authorized and legal.
- ACCOUNTS. You must immediately notify us at email if you learn or suspect that the security of your user name or password has been breached. - PRICING AND PRODUCT ERRORS/CORRECTIONS. - We do our best to keep our inventory current and up to date. However, when you place an order, for local delivery or online orders, we may not be able to fulfill the specific item requested. - FOOD ALLERGENS. ROM AMERICA makes every attempt to identify ingredients that may cause allergic reactions for those with food allergies. Every effort is made to instruct our food production staff on the severity of food allergies. In addition, we label items with possible allergen-containing ingredients; however, there is always a risk of contamination. There is also a possibility that manufacturers of the commercial foods we use could change the formulation at any time, without notice. Customers concerned with food allergies need to be aware of this risk.
Please be aware that our facility prepares foods and uses ingredients in our products that contain nuts or nut oil. If you have any type of food allergy, please refrain from eating our products.
Food Allergies involve the immune system. A protein within a food, known as the allergen, triggers a reaction from the immune system. The body tries to protect itself from the allergen by producing antibodies. These antibodies cause the body to release chemicals, which produces an allergic reaction. It is estimated that 10% of the U.S. adult population has a food allergy.
An allergic reaction can occur immediately or up to two hours after eating the food. As the food enters the mouth, it can trigger a tingling sensation in the mouth and possibly, a swelling of the tongue and throat. Then, as the offending food enters the stomach, it can cause cramping, diarrhea, or vomiting. When the allergen enters the bloodstream, it can cause a drop in blood pressure, hives, or asthma. Anaphylaxis, a sudden drop in blood pressure, is life threatening.
